ASAE to Host Webinar Focusing on its Antitrust Case Amicus Brief

On Oct. 24, 2023, the American Society of Association Executives (ASAE) will host a webinar from 10-11 a.m. ET to walk association leaders through ASAE’s recent amicus brief filing with the Supreme Court of the United States (SCOTUS) in a case with major implications for the association community.

ASAE filed the amicus brief Sept. 1 in support of the United States Soccer Federation’s request for the court to review a case that centers around whether a plaintiff challenging an association for alleged antitrust violations can include association members as codefendants solely due to their membership and adherence to the association’s rules, codes and standards. ASAE’s brief highlights the widespread presence of associations in the U.S. and argues that subjecting association members to antitrust lawsuits solely based on their membership and compliance with association ethics codes or other requirements could severely harm both associations and their members. This issue reached SCOTUS previously in 2016, when ASAE also submitted briefs as well but was resolved without a ruling by the Court.
